Terms of Service

These terms govern your use of aetherguard.xyz and any managed IT, cybersecurity, network, cloud, development, or personal security audit service provided by AetherGuard Technologies. Please read them before submitting a request or engaging our services.

1. Agreement to Terms

By accessing aetherguard.xyz, submitting a form, requesting a security audit, or engaging AetherGuard Technologies (“AetherGuard,” “we,” “us”) for services, you agree to be bound by these Terms of Service. If you do not agree, do not use our website or services. For paid engagements, a signed statement of work, service agreement, or order form may supplement these terms; if there is a direct conflict, the signed agreement controls for that engagement.

2. Description of Services

AetherGuard provides the following categories of service, each described in full on the corresponding pages of our website:

  • Managed IT Services: ongoing infrastructure management, patching, monitoring, and administrative support
  • Cybersecurity Services: security assessments, hardening, monitoring, and incident response
  • Network Infrastructure Services: design, configuration, and maintenance of business network environments
  • Web Development and Custom Software Development
  • Cloud Solutions: architecture, migration, and management
  • Home Network Security: residential network hardening and monitoring
  • Personal Security Audits: Free Surface Audit, In-Depth Security Audit, Elite Privacy Protection, and Executive Protection Plan, plus related add-ons (data broker removal, account lockdown, SIM swap risk assessment, home network review)

Specific deliverables, timelines, and pricing for a given engagement are as described on the relevant service page at the time of your order, or in a separate signed agreement.

3. Personal Security Audits & OSINT-Based Services

Our personal security audit services are conducted using ethical, lawful open-source intelligence (OSINT) methodology. We search only surface web sources, publicly accessible records, data broker listings, and breach databases that are legally accessible. We do not access private accounts without authorization, do not break into systems, and do not use unlawful means to gather information as part of any personal security audit.

Because these audits depend on what information is publicly or semi-publicly available at the time of investigation:

  • We do not guarantee that a report identifies every instance of your exposed information, nor that no further exposure exists beyond what is reported
  • Reports and recommendations are provided for informational and remediation purposes only, and do not constitute legal, financial, law enforcement, or professional advice
  • You are responsible for acting on the remediation steps we provide; we are not responsible for exposure that persists because recommended steps were not taken
  • You must submit only your own information, or information you are authorized to submit on behalf of another person (e.g. a minor dependent), for audit purposes. Submitting another adult's information without their consent is a violation of these Terms

4. Eligibility & Client Responsibilities

You must be at least 18 years old, or a duly authorized representative of a business, to request our services. You agree to provide accurate, current information when submitting any form, and to use our website and services only for lawful purposes. For cybersecurity, network, or IT engagements that involve access to your systems or networks, you confirm that you own those systems or are otherwise authorized to grant us access to perform the requested work.

5. Free Security Audit Terms

The Free Surface Audit is offered at no cost and with no purchase obligation. Estimated delivery (currently 3-5 business days) is an estimate, not a guarantee, and may vary with request volume. We reserve the right to limit the Free Surface Audit to one request per person or household, and to decline a request that appears abusive, automated, or made in bad faith.

6. Fees, Billing & Subscriptions

One-time services (such as the In-Depth Security Audit or add-on services) are billed at the price listed at the time of order. Elite Privacy Protection and Executive Protection Plan are recurring subscriptions billed monthly or annually as selected at signup, and renew automatically until cancelled. You may cancel a subscription at any time through your account or by contacting us; cancellation stops future billing but does not refund the current billing period unless required by law. Fees for custom managed IT, cybersecurity, or development engagements are set out in the applicable statement of work or invoice.

7. Managed IT & Cybersecurity Engagements

Managed IT, network, cloud, and cybersecurity engagements are scoped individually and, where applicable, governed by a separate signed statement of work or service agreement covering scope, deliverables, and service levels. Standard business hours are Monday through Friday, 8:00 AM to 6:00 PM EST; emergency support availability depends on your specific service tier and is defined in your engagement agreement. Cybersecurity work such as penetration testing or vulnerability assessments is performed only within the scope and authorization defined in a signed agreement.

8. Intellectual Property

All content on aetherguard.xyz, including text, graphics, logos, and site design, is the property of AetherGuard Technologies unless otherwise noted, and may not be copied or reused without permission. Deliverables such as audit reports and custom software are licensed or owned according to the terms of your specific engagement or order; absent a separate written agreement, audit reports are provided for your personal or internal business use only.

9. Confidentiality

We treat information you share with us in connection with an audit or engagement, including findings, credentials, and system details, as confidential, and we will not disclose it to third parties except as described in our Privacy Policy or as required by law.

10. Disclaimers & Limitation of Liability

No cybersecurity, IT, or monitoring service can guarantee that a breach, compromise, data exposure, or cyberattack will never occur. Our services are provided on a commercially reasonable, “best efforts” basis using industry-standard practices. Except where prohibited by law, our website and services are provided “as is” without warranties of any kind, and AetherGuard Technologies is not liable for indirect, incidental, or consequential damages, including losses arising from a security incident that occurs despite our services, or from exposure not identified by a personal security audit. To the fullest extent permitted by law, our total liability for any claim relating to a service is limited to the amount you paid for that specific service.

11. Indemnification

You agree to indemnify and hold AetherGuard Technologies harmless from claims, damages, or expenses arising from your misuse of our website or services, your breach of these Terms, or your submission of information you were not authorized to submit.

12. Termination

We may suspend or terminate access to our website or services if we reasonably believe these Terms have been violated, or if required by law. You may stop using our website or cancel a subscription plan at any time as described in Section 6. Provisions that by their nature should survive termination (including confidentiality, intellectual property, and limitation of liability) will survive.

13. Governing Law

These Terms are governed by the laws of the State of Oklahoma, United States, without regard to conflict-of-law principles, unless a separate signed engagement agreement specifies otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
